Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("Policy") governs your use of Killswitch. By using the Service, you agree to comply with this Policy and use the Service only for lawful purposes.

Violation of this Policy may result in immediate account suspension or termination without refund, and may be reported to law enforcement authorities.

2. Prohibited Content

You may NOT upload, store, or share content that:

2.1 Illegal Content

  • Child Sexual Abuse Material (CSAM) - Any content depicting minors in sexual or exploitative situations
  • Terrorist content - Content promoting, supporting, or facilitating terrorism or violent extremism
  • Human trafficking - Content facilitating human trafficking or exploitation
  • Drug trafficking - Content facilitating illegal drug sales or distribution
  • Weapons trafficking - Content facilitating illegal weapons sales or distribution
  • Stolen goods - Content related to theft, fraud, or sale of stolen property
  • Counterfeit goods - Content related to production or sale of counterfeit items
  • Illegal gambling - Content facilitating unlicensed or illegal gambling operations

2.2 Harmful Content

  • Malware and viruses - Malicious code, ransomware, trojans, or other harmful software
  • Phishing materials - Content designed to steal credentials or personal information
  • Hacking tools - Tools or guides for unauthorized computer access (except for authorized security research)
  • Exploits and vulnerabilities - Unreported zero-day exploits intended for malicious use

2.3 Violent and Abusive Content

  • Extreme violence - Graphic depictions of violence, gore, or torture
  • Self-harm content - Content promoting suicide, self-injury, or eating disorders
  • Harassment and threats - Content intended to harass, threaten, or intimidate others
  • Hate speech - Content promoting violence or hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Doxxing - Sharing private information about individuals without consent for malicious purposes

2.4 Intellectual Property Violations

  • Pirated content - Copyrighted movies, music, software, books, or games without authorization
  • Trademark infringement - Unauthorized use of trademarks or brand materials
  • Trade secret theft - Stolen confidential business information or trade secrets

2.5 Spam and Fraud

  • Spam content - Mass unsolicited commercial messages or promotional material
  • Scam materials - Content designed to defraud others (ponzi schemes, fake invoices, etc.)
  • Identity theft - Content containing stolen personal information, credentials, or documents
  • Financial fraud - Content facilitating tax evasion, money laundering, or other financial crimes

3. Prohibited Activities

You may NOT:

3.1 Service Abuse

  • Excessive usage - Intentionally consuming disproportionate system resources
  • Account sharing - Sharing account credentials or allowing unauthorized access
  • Multiple accounts - Creating multiple accounts to circumvent limits or restrictions
  • Reselling - Reselling or sublicensing the Service without authorization

3.2 Security Violations

  • Hacking attempts - Attempting to gain unauthorized access to the Service or other users' accounts
  • Vulnerability exploitation - Exploiting security vulnerabilities for malicious purposes (responsible disclosure encouraged)
  • Reverse engineering - Decompiling, reverse engineering, or attempting to extract source code
  • Automated access - Using bots, scrapers, or automated tools without authorization
  • DDoS attacks - Attempting to disrupt or overload the Service
  • Bypassing restrictions - Circumventing rate limits, access controls, or security measures

3.3 Interference

  • Service disruption - Interfering with other users' ability to use the Service
  • False reports - Submitting false abuse reports or support requests
  • Impersonation - Impersonating Killswitch staff, other users, or entities

3.4 Legal Violations

  • Illegal activity - Using the Service to facilitate any illegal activity
  • Regulatory violations - Violating export controls, sanctions, or other regulations
  • Privacy violations - Collecting or storing personal data in violation of privacy laws

4. Acceptable Uses

Killswitch is designed for legitimate personal and business use, including:

  • Storing personal documents, photos, and files
  • Backing up important business documents and records
  • Sharing files securely with authorized recipients
  • Estate planning via Deadman Switches for beneficiaries
  • Protecting sensitive information with zero-knowledge encryption
  • Legitimate security research with responsible disclosure

5. Reporting Violations

If you become aware of content or activity that violates this Policy, please report it to us immediately:

Include as much detail as possible:

  • Description of the violation
  • Account username or email (if known)
  • URLs or file identifiers (if applicable)
  • Any supporting evidence

All reports are investigated. We may not be able to provide updates on specific investigations for privacy and security reasons.

6. Enforcement

6.1 Investigation

We reserve the right to investigate suspected violations of this Policy. This may include:

  • Reviewing account activity logs
  • Analyzing file metadata (not contents - we cannot decrypt files)
  • Monitoring IP addresses and usage patterns
  • Cooperating with law enforcement investigations

6.2 Actions We May Take

Upon finding a violation, we may:

  • Warning - Issue a warning for minor or first-time violations
  • Content removal - Remove specific files or content (where identifiable)
  • Account suspension - Temporarily suspend account access
  • Account termination - Permanently terminate account without refund
  • IP ban - Block access from specific IP addresses or ranges
  • Legal action - Report violations to law enforcement or pursue civil action

6.3 Severity and Response

The severity of our response depends on:

  • Nature and severity of the violation
  • Whether it was intentional or accidental
  • History of prior violations
  • Harm caused to others or the Service
  • Legal requirements or obligations

Serious violations (CSAM, terrorism, violent threats) will result in immediate account termination and law enforcement reporting.

7. Encryption Architecture and Limitations

Important Technical Note

Regarding our encryption architecture:

  • We do not have access to your encryption password or master key
  • We CANNOT proactively view or scan the contents of your encrypted files
  • We rely on user reports, metadata analysis, and usage pattern detection for enforcement
  • When you share files or configure Deadman Switches, you delegate authority to us to provide access links to your designated recipients
  • Access links can be configured to expire and can be revoked at any time

This does NOT exempt you from this Policy. You are still prohibited from storing illegal or harmful content, and violations discovered through reports or metadata will be enforced.

8. Legal Obligations

We comply with applicable laws, including:

  • DMCA - We respond to valid DMCA takedown notices for copyright infringement
  • CSAM reporting - We report child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC)
  • Law enforcement - We cooperate with valid legal requests (subpoenas, warrants, court orders)
  • Export controls - We comply with U.S. export regulations and sanctions

9. Appeals

If your account is suspended or terminated for an alleged violation, you may appeal by contacting:

Include:

  • Your account email
  • Explanation of why the enforcement action was incorrect
  • Supporting evidence

We will review appeals in good faith, but decisions are final and at our sole discretion.

10. Changes to This Policy

We may update this Acceptable Use Policy at any time. Changes will be posted on this page with an updated "Last Updated" date.

Continued use of the Service after changes constitutes acceptance of the updated Policy.
